Name of the Organization: Constitutional Oversight Posse (COP)
The Plan
Mission: To hold to account any government official who violates the oath to support and defend the Constitution of the United States.
Philosophy:
The United States is not governed by elected officials. It is governed by a document—a document called the Constitution. Unlike humans, the document is fair and impartial. The document acknowledges and protects the natural freedoms, rights, and property of all of the people, contrary to the selfish interests of career politicians and their cronies.
The Constitution overrides the dictates of government officials. It carries the will of the people who ratified it. It may be changed by the amendment process only. It may not be changed by twisted interpretations of its words, by errant precedents set by disobedient judges, or by the pressure of a mob-rule majority.
As the Declaration of Independence points out, it is the duty of the people to correct a government that persistently violates its charter. The government over the last century has demonstrated its inability to restrain itself from violating the Constitution. The government has been indulging in the exercise of powers that would never have been ratified by the prescribed amendment process. Congress, the Executive Branch, and the Supreme Court have all been complicit. To rectify this problem, the Constitutional Oversight Posse has been instituted by citizens of the United States to enforce the Constitution and to ensure that any government official so presumptuous as to try to override the will of the people who ratified the Constitution and its amendments shall be duly brought to justice.
The Means to the End:
The COP will grow its membership until it has at least one million signed members who are eligible to vote in the United States. Membership will be contingent on members being in full agreement with the written mission, philosophy, and means of the COP. Any member misrepresenting the organization’s charter may be expelled from the organization.
During its growth phase the COP will conduct activities intended to chip away at the unconstitutional actions of government officials and to identify those individuals who are violators of the Constitution. Once the required membership level has been reached, the COP’s governing board will identify the enforcement officials who are legally responsible for impeaching, expelling, and/or arresting and prosecuting the violators. The Board will present to each enforcement official an ultimatum and the list of violators who must be prosecuted. The ultimatum will set deadlines by which the prosecutorial duties must be performed. The ultimatum will inform the enforcement officials that failure to carry out these duties within the set time limits will, in the opinion of the COP, render the enforcement officials liable for arrest for violations of their oath of office, a high crime under the Constitution.
If the COP should deem as warranted the arrest of a government official accused of violating the oath of office, the COP will seek to have a state government authority conduct an arrest, establish bail, and set a trial date. If the state government authority should be delinquent in carrying out this constitutional duty, the COP will seek to have a local government authority, such as a county sheriff, arrest the delinquent state authority. If the local government authority reneges on this responsibility, the COP will seek to have the errant local authority subjected to a presentment by a citizen's grand jury and will insist, under the threat of stiff penalties, that the local justice system prosecute the case. The COP will continue selecting and prosecuting local authorities until one can be found who will arrest the delinquent state authority and then will continue selecting and prosecuting state authorities until one can be found who will arrest and subject to trial the government official accused of breaking the oath.
The COP may conduct voluntary arrests. In the event that a voluntary arrest must be arranged, the COP will first identify a legal body within a state or local government to whom the official to be arrested will be instructed to surrender himself or herself. This legal body will be held accountable by the COP for performing due diligence and follow-up appropriate for a case involving high crime.
No attempt at securing the arrest of an official will be conducted without the participation, at the site of the action, of at least some predesignated number of members of the COP (ten thousand being an example) and the assent of at least a majority of the remaining members of the COP. No assault and no physical restraint may be used by COP members on the arrested official. No armaments may be illegally employed in the action. Any restraints by COP members on an arrested official’s mobility will be within the limitations of the First Amendment right to assemble.
The COP’s operations will be conducted openly with maximum access by the news media. Publicity will be sought for the sake of educating the public concerning the Supreme Law of the Land—the Constitution—and the importance of enforcing this governing document against the self-serving interests of all government officials who would violate it.
Bylaws:
The COP’s founders will appoint a governing board for the COP and will generate and codify the means by which a new governing board may be elected by the membership on an annual basis.
The governing board will set additional bylaws and policies of the COP in writing and will plan and coordinate the execution of COP activities. Only activities pre-approved by the governing board may be conducted under the auspices of the COP.
Only COP members may be members of the governing board.
Actions:
The first major action of the COP after the membership surpasses one million people will likely be the issuance of an ultimatum to the Speaker of the House warning him/her that arrangements will be made for his/her arrest, as described above, unless he/she initiates within one month the impeachment and/or other legal proceedings required to remove from office the officials that the COP has designated as enemies of the Constitution and to do so in a manner that will result, to the maximal extent, in the negation of the unconstitutional actions these designated officials have taken while in office. The COP will then use its ultimata to hand-hold each and every one of the representatives and senators through the most expeditious constitutionally-allowed process leading to the expulsion of the accused.
The COP will thereafter continue to act as enforcer of the Constitution, managing the expulsion of one violator of the Constitution after another, thereby chastening an otherwise errant government and restoring the Constitution as the legitimate ruler of the United States.
Given the large backlog of violators of the oath and of the Constitution, the COP is likely to be a very busy organization. It will be a very productive organization, as well, since for every official either arrested or expelled from the government there will be at least ten who will be careful thereafter not to cross the line.
